Alpine Brand Store terms of delivery

1 General

1.1 Alpine Brand Store is an online store maintained by Pro Ski Center Oy Oy (business ID 2265420-8) (hereinafter referred to as the ”Seller”). More specific contact details of the Seller are available on the Alpine Brand Store website. These terms and conditions govern the commercial relationship between the Seller and its customers. The customer must accept these terms of delivery in order to place an order through the website and is deemed to have accepted them after placing the order. By accepting these terms of delivery the customer agrees to be bound by these terms in their entirety. The Seller has the right to update these terms without prior notice. All orders shall be governed by the terms of delivery in force at the time of the order, available at the Alpine Brand Store website at here.

Agreement and orders

2.1 Alpine Brand Store supplies products for both consumer and business customers. The customer is obliged to provide its full contact details at the time of placing the order, and the customer shall be liable towards the Seller for the correctness of all information provided by the customer. The Seller shall be entitled to compensation for damages due to any incorrect information provided by the customer. 2.2 The agreement is concluded when the Seller has confirmed the customer’s order, and the customer has received an order confirmation via email from the Seller. The customer has the right to cancel the order until the Seller has confirmed it. If the order is cancelled, the Seller shall return all payments made by the customer or its credit card company in connection with the order.

2.3 The Seller may reject the customer’s order, cancel the agreement or change the terms thereof, if the customer has provided an incorrect personal or corporate registration number or other erroneous information.

2.4 The features, availability and price of a product as well as available delivery methods and costs of delivery are indicated in connection with the selection and purchase of the product. All prices are in euro and include the VAT. The prices are not inclusive of payment and delivery costs, which are indicated separately.

2.5 The indicated delivery times are merely estimates and not binding times of delivery. The estimates for delivery time are given based on the Seller’s stock situation and estimated delivery times provided by the manufacturers. The estimated delivery time is indicated in the order confirmation, at the checkout and/or on the respective site of the product at the online store. The Seller shall not be liable for delays caused by unforeseen changes, but shall notify these to the customer without undue delay. The Seller shall not be liable for delays caused by circumstances which are not within the Seller’s reasonable control, such as delays caused by the actions of a logistics operator.

2.6 The Seller shall not be liable to compensate the client or to fulfil its delivery obligation if the products are no longer available or in case of errors on the website (e.g. errors in product descriptions or technical specifications), erroneous prices or erroneous information regarding the stock situation. The Seller has the right to correct any such errors and to change or update any information at any time. The Seller has the right to cancel an order in case the price indicated at the online store clearly differs from the market price due to a pricing error. The Seller is not responsible for any information on the website provided by third parties.

3 Delivery of the products

3.1 Delivery is available to the following countries:

Argentina,  Australia, Austria, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Canada, Chile, China, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Monaco, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Republic of Korea, Republic of Macedonia, Romania, Russia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Ukraine, United Kindom, United States.

* Packs over 150 cm in length (such as skis) can be delivered to countries with bold text.

3.2 The available delivery methods are specified below. The Seller reserves the right to change the method of delivery after the confirmation of the order. The Seller will not charge the customer for any additional costs due to changes in the method of delivery.

3.3 In case the package is to be collected from a certain point of delivery, the customer shall collect it within the time period specified in a notice of arrival. If the package is not collected, the Seller has the right to charge the customer for direct costs incurred from the handling of the uncollected package.

3.4 The customer shall check the condition and possible damages of the package at the time of collection of the delivery. In case the package has been damaged during the transportation by the transport company, the customer shall make a damage report immediately at the point of collection. Please also contact Alpine Brand Store / Pro Ski Center Oy in order to agree on the delivery of a new product.

3.5 For orders made by business customers, the risk for the ordered products shall pass to the customer when the Seller delivers the goods to a transport company.

4 Payment Methods

4.1 The available payment methods are specified below.

We accept Visa, MasterCard or American Express via our payment provider Paytrail. Orders can be made also through the Alpine Brand Store website via PayPal and Klarna (Klarna payments awailable in Austria, Finland, Germany, Norway and Sweden) by using your account.

4.2 The business customers registered as Alpine Brand Store account customers can also place orders which will be charged by issuing an invoice. The products will be delivered normally after the placement of the order, and the invoice will be sent as agreed after the placement of the order (term of payment is 14 days net). 5 Warranity, support and liability for defects

5.1 Alpine Brand Store sells original products purchased from Finnish importers. The product warranty is determined in accordance with the warranty terms of the manufacturer or importer. The customer is obliged to familiarise himself with the warranty terms before commencing the use of the products. The warranty terms can be found in the user manual, a separate warranty form or the website indicated by the manufacturer or importer. The order confirmation from the online store (the customer receipt) serves also as the warranty certificate of the product. The Seller is responsible for the statutory liability for defects. In case of defects, the customer shall in first place contact the warranty services of the manufacturer.

5.2 The warranty period for a device acquired for business use or by a business customer shall be determined in accordance with the warranty terms of the manufacturer, and the expiration of the warranty period shall at all times terminate the Seller’s liability.

5.3 A consumer customer has the right to receive compensation for damages suffered due to a defect in the goods in accordance and subject to mandatory law. In case mandatory law does not otherwise dictate, the maximum damage is limited to the price of the product ordered and deemed defective. The Seller is however liable towards the consumer customer for indirect or consequential loss only if the defect or loss is caused by negligence on the part of the Seller or if the goods did not at the time of the conclusion of the contract conform to an express warranty given by the Seller.

5.4 The Seller shall not in any circumstances be liable for any indirect or consequential loss caused by a device acquired for business use or by a business customer. The Seller’s liability for defects or delay caused by a device acquired for business use or by a business customer is in any case always limited to the amount paid for the defective or delayed product.

6 Force majeure

6.1 The Seller is not responsible for damages caused by an event of force majeure. Event of force majeure means an unforeseeable event or change in circumstances which is beyond the Seller’s control. The Seller is obliged to inform the customer of the force majeure event without undue delay.

7 Additional terms for consumer customers

7.1 Cancellation and return

7.1.1 A consumer customer has the right to cancel an order within 14 days from receiving the product. You can notify us of your intention to cancel the order with an unequivocal statement, e.g. by sending a letter by mail or email at customerservice(at)alpinebrandstore.com, or by using our withdrawal form. You can download the customer returns / withdrawal form here. If a completed customer returns / withdrawal form is returned together with the products within 14 days from receiving the order, no separate notice of withdrawal is required.

RETURNS FORM

When returning packages we recommend to use use tracked delivery, as we assume no responsibility for lost or delayed returns. We will only assume responsibility of the package when it has arrived at our store.

Customer has to pay the costs incurred by the return shipment. Please ensure return orders with sufficient postage. For returns from non-EU countries high costs can be incurred due to tariff regulations, import taxes etc. These costs are to be borne by customer.

7.1.2 The limitations for the right of withdrawal are in accordance with Chapter 6 Section 16 of the Finnish Consumer Protection Act. The right of withdrawal does not apply e.g. to products that are manufactured or modified according to the customer’s requirements or to meet the personal needs of the customer.

7.1.3 If a customer uses its right of withdrawal, they must bear the cost of returning the product. In addition, the customer is responsible for the product’s condition after accepting delivery and during the return transport. The product shall be returned within 14 days from the notice of withdrawal. The product must be returned properly packed, in good condition and in its original box and/or packaging.

7.1.4 If the returned product has been used in violation of the duty of care belonging to the customer, the Seller may charge the customer for the product’s depreciation in value up to the full price of the product as well as the return costs. 

7.1.5 In case the product received by the customer is broken or defective, the customer shall contact the Seller without undue delay.

7.2 Effects of cancellation

7.2.1 The seller shall return all payments of returned products (not including delivery costs) received in connection with the cancelled order without undue delay.

7.2.1 The seller shall return the paid price by using the same payment method that the customer has used in the original transaction. The payments will be returned within 14 days from the date when we have received the products or after the customer has demonstrated the return of the products, whichever is the earlier. We ask you to carefully store all the documents related to the customer return until you have received confirmation on the receipt of the returned products from us.

7.3 Dispute resolution

7.3.1 Disagreements and disputes shall primarily be resolved through negotiations. In case a disagreement arising from the contract cannot be resolved through negotiations between the parties, a consumer customer may take the issue to the Finnish Consumer Disputes Board (http://www.kuluttajariita.fi) or a similar dispute resolution body if applicable.
